By downloading or using Verbora, you agree to these terms. If you do not agree, do not use the app. Your use of Verbora is also subject to our Privacy Policy.
Eligibility
Verbora is available to users of all ages. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms.
What Verbora provides
Verbora is an Italian vocabulary learning app that uses spaced repetition to help you build and retain vocabulary, available on iPhone and Apple Watch. The app is provided as-is for personal, non-commercial educational use.
License
Subject to your compliance with these terms, Danmomo grants you a limited, non-exclusive, non-transferable, revocable licence to download and use Verbora on Apple-branded devices that you own or control, for personal, non-commercial purposes. This licence is subject to the Usage Rules set forth in Apple's Media Services Terms and Conditions.
Your content
Your learning data, progress, and preferences are stored locally on your device. You retain full ownership of your data. We do not access or collect it.
Vocabulary content
The Italian vocabulary and translations included in Verbora are curated by Danmomo. While we strive for accuracy, language is nuanced. Verbora is a learning aid, not a certified language reference.
Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the app
- Copy, redistribute, or sell the app's vocabulary content
- Use the app in any way that violates applicable laws
Intellectual property
Verbora, its design, code, vocabulary content, name, and logo are the property of Danmomo. All rights reserved. Apple, iPhone, Apple Watch, and App Store are trademarks of Apple Inc.
In-app purchases
Verbora may offer optional in-app purchases or subscriptions in the future. Purchases are processed through Apple's App Store and subject to Apple's terms. Subscription details, pricing, and cancellation policies will be presented before purchase. You may manage or cancel subscriptions through your Apple ID settings. By completing a purchase, you expressly agree to the applicable pricing and terms presented at the time of purchase.
Termination
We may terminate or suspend your access to Verbora at any time, without prior notice, for conduct that violates these terms. Where practicable, we will provide notice and an opportunity to address the issue before termination, except in cases of serious or repeated violations. Upon termination, the provisions that by their nature should survive (including intellectual property, limitation of liability, and indemnification) will remain in effect.
Disclaimer of warranties
We work hard to make Verbora useful and reliable, but we cannot guarantee it will be perfect. To the maximum extent permitted by applicable law, Verbora is provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the app will be error-free or that learning outcomes are guaranteed.
Limitation of liability
To the maximum extent permitted by law, Danmomo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Verbora. In no event shall Danmomo's total liability for direct damages exceed the amount you paid for Verbora in the twelve (12) months preceding the claim.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Danmomo from any claims, damages, or expenses arising from your violation of these terms or misuse of Verbora.
Apple
You acknowledge that these terms are between you and Danmomo only, not with Apple. Danmomo, not Apple, is solely responsible for any maintenance and support of Verbora. In the event the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Danmomo, not Apple, is responsible for addressing any claims relating to Verbora, including product liability claims, any claim that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation. In the event of any third-party claim that Verbora or your use of it infringes a third party's intellectual property rights, Danmomo, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of such claim. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
Availability
We may update, modify, or discontinue Verbora at any time. We will make reasonable efforts to maintain the app but do not guarantee uninterrupted availability.
Changes to these terms
We may update these terms. Changes will be posted on this page with a revised effective date. For material changes, we will provide notice through the app. Continued use of Verbora after changes constitutes acceptance.
Governing law
These terms are governed by the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore. These terms are drafted in English. If translated, the English version prevails in case of conflict.
Severability
If any provision of these terms is found unenforceable, the remaining provisions continue in full force.
Entire agreement
These terms, together with the Privacy Policy, constitute the entire agreement between you and Danmomo regarding Verbora, superseding any prior agreements.
Waiver
Our failure to enforce any provision of these terms shall not constitute a waiver of that provision.
Assignment
Danmomo may assign these terms without restriction. You may not assign your rights under these terms without our prior written consent.
